The policies contained herein apply to the ‘Nikka Fishing & Marine’ WebStore.  WebStore policies sometimes vary from ‘Nikka Fishing & Marine’ retail store policies. Please note, contact with the WebStore occurs automatically when you use the WebStore’s online order processing facilities.

Purchasing by Minors
For the protection of our shoppers, it is our policy to not sell to minors. If you are under the legal age of majority and wish to purchase from our online store, please have a parent or legal guardian make the purchase for you.

Purchasing Agreement
By purchasing a product from Nikka Fishing & Marine, you agree that you are bound by the following Terms and Conditions:

• All risk of loss and damage to a product passes to you upon shipment of the product purchased.  We are not responsible for any acts or omissions in connection with the packing or shipping of the products or of the carriers, whether or not recommended or selected by us.
• You shall pay any applicable Federal and Provincial taxes, and any applicable compensating use tax or duty of another Province/State for which we may be required by law to collect at the time of the payment of the purchase price.
• These Terms and Conditions of Sale, as well as your and our respective rights and obligations hereunder shall be governed by and construed and enforced in accordance with the laws of British Columbia. You consent to the exclusive jurisdiction with any product purchased from us. In no event shall our liability ever exceed the purchase price actually paid by you for such product.
• Every attempt is made to provide accurate information and images for the product being displayed on this web site, however, we take no responsibility if the information is incorrect.

Privacy/Security
This WebStore holds the highest respect for its customers and guarantees our firm commitment to your privacy. We do not sell any of the information provided by you to any other institutions. By registering with us and/or buying products from us online you will automatically be added to our customer database. If at any time you would like to be removed from our list, simply e-mail or contact us at the store, and you will be removed immediately.

As a customer, you reserve the right to be concerned about the security of your credit card information. Please be assured that your financial information is sent to us via encrypted data and can therefore not be hacked, received, or deciphered by other merchants or people with malicious intent. All your personal and account details are stored on a secure Web server, and when you place your order you will be taken to a secure server – which can be identified by a locked padlock symbol in the status bar of your Internet browser.  If you are still not comfortable with releasing your credit card information via our Web site, you may call (800) 830-6332 to place your order directly over the phone.

Please note that no orders will be considered complete until payment has been submitted and approved.

Although reasonable care has been taken to ensure that the descriptions are accurate, specifications are subject to change and ‘Nikka Fishing & Marine’ does not accept responsibility for discrepancies, either real or perceived.

Prices
Prices quoted are valid at the time of production. Due to circumstances beyond our control, prices may change at any time.  All products offered by the WebStore are subject to availability.

Order Confirmation
WebStore orders are confirmed by e-mail as soon as we receive your order so please ensure that you submit your correct e-mail and telephone details on the order form. If we have any queries regarding your order we will contact you via e-mail or telephone during normal business hours. 

Products Out of Stock
If you place an order and the products are out of stock, we will inform you as soon as possible via e-mail or telephone during normal business hours. If your order contains multiple items, we can either wait for the out-of-stock item to arrive and ship everything together, or ship the order separately.

Canceling or Altering Orders
You may cancel or alter your order at any time prior to its shipment. Altered orders may be subject to a small delay as the order is repackaged, etc. Please have your order details ready when phoning us to amend an order.

When Will My Order Be Shipped?
Orders received before 12:00 p.m. Monday to Friday will be shipped the same day (provided we have your items in stock).

• Items ordered after 12:00 p.m. on Friday and over a weekend will be shipped the following Monday.
• Items ordered over a bank or statutory holiday will be shipped the next working day.

‘Nikka Fishing & Marine’ stock status is constantly updated but demand is high and we occasionally run out of stock on popular items. If for this reason we cannot ship your order, we will contact you with a revised shipment date.

Return Policy
Contact ‘Nikka Fishing & Marine’ because problems can often be resolved without incurring unnecessary postal charges. If however it is deemed necessary to return an item for exchange or refund please note the following:

• You must request an RMA number from ‘Nikka Fishing & Marine’ before returning any items.
• All products must be accompanied by the receipt and a note outlining the reason for return.
• Returned products must be in their original packaging, with labels still attached.
• Please do not use the product box itself as your shipping package.
• Products must be returned within (30) thirty days of receipt, (15) fourteen days for electronic items and electronics accessories.
• Products returned may be subject to a minimum restocking charge of 15%.
• Products listed in our Clearance sections are not refundable, but can be exchanged, unless otherwise noted.
• Products must be in new condition, that is, unused and unmarked.
• Costs incurred in posting the returned items are not refundable.

GPS / Software Bundles
We are not able to accept returns on any electronics product that includes bundled software if the software has been opened or unlocked. If the software package has been opened but the CD is unopened and the software has not been unlocked a 15% restocking fee will be charged.

Software
Opened software cannot be returned unless defective. By opening software, you agree to the license agreement established by the software publisher and we must abide by these terms. Please make use of online map viewers to check whether the map coverage is suitable for your requirements before opening any software package!

Software Unlock Certificates
Opened Software Unlock Certificates cannot be returned for refund.

Books and Hydrographic Publications
Books and Hydrographic publications cannot be returned.

Special Order Item Returns
Returns of items which have been specially ordered for you or volume purchases of the same item will not be accepted.
